What is a DBS?
A DBS (Disclousure & Barring Service) check is a background check that reveals any criminal activity that an individual may have. These checks are typically required for roles that involve one to one care, unsupervised contact with children or vulnerable people.
The Law
Entertainers normally work one-off events/functions and should never be left alone with an audience of young or vulnerable people. The law mandates people who have regular contact or unsupervised contact with the young or vulnerable must have an enhanced DBS. Entertainers do not fall into that catagory. In short, Entertainera are in a unregualted catagory.
It's important to know that it's a breach of the law to ask for a DBS if the law states the role does not meet the criteria. See below regulations;
Rehabilitation of offenders act 1974 (exceptions) order 1975 and Police act 1974.
If your company/school has a policy asking for a DBS, then that too is against the law if the role does not meet the criteria and may also breach Data Protection laws.
Safeguarding is paramount for both the audience and the entertainer as the DBS certificate states that all information is private and confidential.
Working Together
Pete Goldsmith (PJ) holds a DBS and is more than happy to provide the Policy/DBS number only. No photo copies and no touching of any paper work. If it is necessary that a copy of the performers DBS is taken, then a written request must be made along with a copy of any company Data Protection Policy 28 days prior performance.
A copy of the performers Public Liability is always available along with the PAT certification.
When the performer arrives on site, a business card and formal ID (again, no copies allowed) is always provided to view only. The ID should always match the DBS name and address, after all the DBS could be anyone's if you don't cross check it.
It's important to note: A DBS clause is written into the Terms & Conditions when booking.
